1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you and QUESTIMATIONS OÜ (registry code 17460007), incorporated under the laws of Estonia ("Company", "we", "us", "our").

By downloading, installing, accessing, or using the Predictions.io mobile application or website (the "Service"), you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Description of Service

Predictions.io is a crowd-intelligence forecasting platform that allows registered users to:

• Make probabilistic predictions on real-world events
• View and interact with predictions made by other users
• Track prediction accuracy and performance scores
• Participate in leaderboards and community features

The Service is provided for entertainment, educational, and informational purposes only. Predictions are user opinions, not financial, legal, medical, or professional advice.

3. Eligibility

You must be at least 13 years old (or 16 in jurisdictions where a higher minimum age applies) to use the Service. By using Predictions.io, you confirm you meet this requirement. If you are under 18, your parent or legal guardian must have reviewed and agreed to these Terms on your behalf.

4. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate and complete registration information
• Keep your credentials confidential and secure
• Notify us immediately of any unauthorised access at admin@questimations.com
• Be responsible for all activity under your account

You may not create duplicate accounts, impersonate others, or use a username that is offensive or misleading.

5. User Conduct

You agree not to use the Service to:

• Post unlawful, harmful, threatening, abusive, or hateful content
• Spread deliberate misinformation or manipulate prediction markets
• Infringe any intellectual property or privacy rights of others
• Transmit spam, malware, or any harmful code
• Attempt to gain unauthorised access to our systems or other accounts
• Use automated scripts, bots, or scrapers without written consent
• Engage in activity that disrupts or interferes with the Service

We reserve the right to investigate violations and take appropriate action, including account suspension or termination.

6. Intellectual Property

The Service and all content — including text, graphics, logos, icons, images, and software — are the exclusive property of QUESTIMATIONS OÜ or its licensors, protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for personal, non-commercial purposes. You may not reproduce, distribute, modify, or commercially exploit any part of the Service without our prior written consent.

7. User-Generated Content

By submitting predictions, comments, or other content ("User Content"), you grant us a worldwide, royalty-free licence to use, reproduce, modify, publish, and display such content in connection with operating and improving the Service.

You warrant that you own or have the necessary rights to submit User Content and that it does not violate these Terms or any applicable law. We do not endorse User Content and reserve the right to remove any content at our discretion.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or that information obtained through it is accurate or complete. Predictions are user opinions only and should not be relied upon for financial, investment, legal, or other decisions.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUESTIMATIONS OÜ AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total liability for any claim shall not exceed the greater of €100 or the amount you paid us in the twelve months preceding the claim. Some jurisdictions do not allow certain liability limitations, so the above may not fully apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless QUESTIMATIONS OÜ and its affiliates, officers, directors, employees, and agents from claims, liabilities, damages, and expenses arising out of your use of the Service, violation of these Terms, violation of third-party rights, or any User Content you submit.

11. Third-Party Links & Services

The Service may contain links to third-party websites. We have no control over and assume no responsibility for the content or practices of any third-party sites. We encourage you to review their terms and privacy policies.

12. Termination

We may suspend or terminate your access at any time, with or without notice, if we reasonably believe you have violated these Terms. You may stop using the Service and delete your account through app settings at any time. Provisions that by their nature should survive termination — including IP rights, disclaimers, and liability limitations — shall do so.

13. Governing Law & Disputes

These Terms are governed by the laws of the Republic of Estonia. Any disputes shall first be attempted through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of Tallinn, Estonia.

EU consumers may also use the European Commission's Online Dispute Resolution platform.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide at least 14 days' notice of material changes via email or in-app notification. Continued use of the Service after the effective date constitutes acceptance. If you disagree, you must stop using the Service.
